Terms for using staty

Our terms and privacy policy are intentionally short. Please read what you can expect from staty, and what we expect from users. By using the described staty components (app, feedback form, etc.), you agree to all provisions on this page, including text in “Show/hide details” boxes, and acknowledge the separate privacy information.

Usage of the staty app

Purpose:

staty lets you create a user account, select Google Drive spreadsheets, read and analyze the data in those sheets, and view results in charts. The goal for you is to find significant health benefits or drawbacks from the data.

Disclaimer: staty, its website and the guides do not represent medical advice. We don't advertise specific medication, supplements, treatments or interventions. Neither do we give or display interpretations for your analysis results. We trust that you use your results carefully and follow our common recommendation to consult medical professionals for anamnesis, diagnosis and treatment options.

As an example, you may want to try magnesium supplementation to prevent headaches. You note down intake and headache strength daily, then analyze the effect (or non-efficacy) over time using staty.

Many more cases, even complex ones, are possible. A simple programming language consisting of steps and expressions helps digging through even more complex data. More major features related to health data analysis may be added in the future. The application does not interpret any of the data that it processes or displays. It is only a statistical tool to help you find answers simpler and quicker than, for example, programming this all yourself in Excel. You are responsible for understanding and interpreting your own data, and definitely for any good or bad health decisions that you take based on that.

Allowed:

Using staty to analyze your health or other data from a few spreadsheets is fair usage and you don’t have to worry.

Forbidden / reasons to suspend or terminate your account:

Overuse (large number of requests, very large spreadsheets), abuse, DoS (denial of service), or other behavior that could harm the stability or performance of the application for you or other users
Sharing of your account with someone else, or use of simple passwords or insecure security credentials that could lead to your account being hacked
Reverse-engineering, network scans, injection of harmful content or malware, hacking, or pentesting of any part of the staty application
Automated requests. If you think this could make sense, send us feedback.
Having many secondary accounts (a few are fine for family or different purposes)
Any use directly or indirectly related to making money (must ask for permission)

Notes:

Data is processed on European servers. Use the app only if legal and acceptable.
We minimize e-mail use, contacting you directly only for technical or lawful needs that can’t be handled in the app. You’re welcome to write us e-mails. The feedback form is usually preferred. We’ll require you to accept the latest terms and privacy information for continued app use – no e-mail needed.

We take no responsibility or warranty for analysis correctness, your health decisions, the app or other components not working, or other outcomes from these services, and you can’t sue us for that. Show/hide details ›

Accuracy and correct display of analysis results cannot be guaranteed. Software may always have bugs. You can’t hold us responsible for incorrect results or for any health decisions that you take based on the usage of staty.
The app is provided “as is” without warranty of any kind. We do not guarantee that the app will be error-free or uninterrupted.
To the fullest extent permitted by law, the people developing and working on staty shall not be liable for any indirect, incidental, or consequential damages arising from your use of the app.
Numbers and statistics cannot replace medical professionals and tests. Take responsible decisions and seek professional help first.

Usage of the staty feedback form, e-mail or other means of communicating with the people behind staty

Purpose:

The feedback form is for feature requests and wishes, questions about the staty app or website, and other communication about the project.

By submitting feedback through any of the mentioned communication channels, you grant us a perpetual, irrevocable, worldwide, royalty-free, fully paid-up, non-exclusive, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display your feedback in any form, media, or technology, whether now known or hereafter developed, for any purpose, including but not limited to developing, improving, and promoting staty. The word “feedback” includes questions.

We require a Google-verified e-mail address in the feedback form, both to detect and block spammers, and to reply in case you agreed that you want an answer about your feedback.

Allowed:

Send us constructive feedback, questions or inquiries, containing enough information so an action can be taken. For questions, avoid the “XY problem” and other forms of bad or incomplete questions. Bad: asking about your attempted solution. Good: explain the actual problem you want to solve and include all needed information.
Requests regarding the privacy information must be sent by e-mail, not via the feedback form.

Forbidden:

We have zero tolerance for harassment, abuse and spam via feedback and communication channels. Your account may be suspended, and you may be blocked from communications. Show/hide details ›

This means use of profanity (including the too common f-word), inappropriate wording, spam, etc. via e-mail, feedback form or other communication with the developer(s) and others behind staty.

People who don't write reasonable questions or feedback, and don't invest time researching known solutions in documentation and guides, are easy to recognize. The staty project lacks resources for such messages, and treats repeated useless input as spam. Stored e-mail addresses are used to block known spammers. Severe spam may also result in blocking the related staty account.

Termination

Malbehaving users, as described above, will be suspended from their accounts and possibly blocked from feedback submission and contact. We may also fully terminate such accounts at our discretion. You can terminate your account yourself from within the app (TODO Also not yet implemented, but soon. For now, please send an e-mail.), or as noted in the privacy information.

The whole service may be terminated if it can’t be maintained any longer due to costs, little usage, or for any other reason. All data will be deleted in that case.

Intellectual property

All content and features of the mentioned components are owned by Andreas Sommer. You may not reproduce, distribute, or create derivative works without permission.

(You can however help me to turn this into an open-source, community-driven project over time, by getting the word out to others about the app and giving constructive feedback. I’m happy to open up the project!)

You may take the logo, name, analysis/configuration screenshots and exactly-quoted descriptions (these in full or in reasonable parts) from the staty website or application to share knowledge about the application, such as in health forums, social media, with friends, or other non-commercial purposes. Usage for commercial purposes, for example as part of newspaper or online articles, revenue-generating podcasts/videos/posts, sold products or on work-related websites, needs permission.

Applicable law

These terms are governed by the laws of Germany.

Severability clause

If any provision of the above policy turns out invalid, illegal or unenforceable, the remaining provisions are not affected and the problematic provision shall be replaced with a rule that works according to the applicable laws, as close as possible to the desired purpose of the provision.
